These Terms & Conditions ("Terms") govern your access to and use of BikingConditions.com, including the website, accounts, ride condition tools, bike and rider tools, ride checklists, AI-assisted features, credit purchases, support features, and any related content or services (collectively, the "Service"). By visiting, creating an account, buying credits, submitting information, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
BikingConditions.com is an informational and planning tool. It is not a safety authority, trail manager, weather service, emergency service, professional coaching service, medical service, legal service, financial service, or bicycle mechanic. You are responsible for your own decisions, equipment, route choices, risk assessment, and personal safety.
1. Eligibility and Account Responsibility
You must be at least 18 years old to use the Service or create an account. By using the Service, you represent that you are 18 or older and legally able to agree to these Terms.
You are responsible for the accuracy of information you provide, for keeping your login credentials secure, and for all activity under your account. Notify BikingConditions.com through the contact page if you believe your account has been accessed without permission.
2. Changes, Availability, and Removal of the Service
The Service, including any page, feature, price, credit package, tool, result, model, output, content, database, route, design, policy, or account feature, may be changed, limited, suspended, discontinued, disabled, or removed at any time, with or without notice, for any reason or no reason, at the sole discretion of BikingConditions.com.
BikingConditions.com may take down the entire Service, restrict access to the Service, remove user content, suspend accounts, terminate accounts, block IP addresses, decline support requests, or refuse service at any time to the maximum extent permitted by law. The Service is not guaranteed to be available, uninterrupted, secure, accurate, error-free, backed up, or recoverable.
3. Ride, Weather, Trail, and Safety Disclaimers
Ride condition results, forecasts, weather history, trail surface estimates, checklist suggestions, tire or suspension suggestions, bike insights, rider insights, and AI-generated outputs are informational estimates only. They may be incomplete, outdated, wrong, delayed, unsuitable for your location, or unsuitable for your abilities, equipment, health, route, weather, terrain, local trail rules, or actual on-the-ground conditions.
Conditions can change quickly. Always check official weather sources, trail managers, local closures, posted warnings, landowner rules, road conditions, emergency alerts, and your own observations before riding. Do not rely on the Service as your only source of information. You accept all risks connected with bicycling, outdoor activity, travel, weather exposure, terrain, traffic, mechanical failures, injuries, property damage, and other hazards.
4. AI-Assisted Features
Some features may use AI systems or third-party model providers. AI outputs can contain mistakes, omissions, hallucinations, biased assumptions, outdated information, or unsafe suggestions. You are solely responsible for reviewing AI outputs and deciding whether they are appropriate for your situation.
Do not treat AI output as professional advice. Do not use the Service for emergencies, medical decisions, legal decisions, financial decisions, or any decision where inaccurate information could cause harm.
5. Do Not Submit Sensitive Information
Do not enter, upload, store, paste, or send highly sensitive information through the Service, including in forms, bike notes, rider notes, ride checklists, support messages, AI prompts, feedback, presets, or saved records. This includes Social Security numbers, government ID numbers, passport numbers, driver license numbers, payment card numbers, bank account information, passwords, authentication codes, private keys, seed phrases, medical records, health insurance numbers, tax records, precise personal secrets, or any other information that could create serious harm if exposed.
The Service is not designed to store regulated, financial, medical, or other highly sensitive data. You are responsible for the information you choose to provide.
6. Payments, Credits, and Billing
The Service may offer one-time credit purchases that can be used for paid tools or AI-assisted features. Credits are a limited, revocable, non-transferable license to access eligible Service features. Credits are not money, stored value, gift cards, securities, or property; they have no cash value and cannot be transferred, sold, redeemed for cash, or exchanged outside the Service.
Credit packages, prices, included credits, usage costs, purchase limits, free credits, promotional credits, available features, and billing rules may change at any time. Purchases are final except where a refund is required by law or expressly approved by BikingConditions.com in its sole discretion. Payment processing may be handled by Stripe or another third-party payment provider, and your payment use may also be subject to that provider's terms and policies.
7. User Content and License
You are responsible for any information, text, ride details, bike details, rider details, checklist items, support messages, feedback, or other content you submit ("User Content"). You represent that you have the right to submit your User Content and that it does not violate the law or anyone else's rights.
You grant BikingConditions.com a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, modify, analyze, and use your User Content as needed to operate, secure, maintain, improve, troubleshoot, and provide the Service.
8. Prohibited Conduct
You may not misuse the Service. Prohibited conduct includes attempting unauthorized access, scraping, overloading, probing, reverse engineering, bypassing limits or security controls, sharing abusive or illegal content, impersonating others, interfering with other users, exploiting bugs, using the Service for unlawful purposes, or using automated systems in a way that harms or burdens the Service.
You agree not to use the Service for malicious, destructive, fraudulent, harassing, abusive, threatening, deceptive, or harmful purposes. You may not use the Service to transmit malware, steal data, harvest accounts, test or exploit vulnerabilities, launch or assist denial-of-service attacks, damage or disable systems, impair the Service, interfere with security features, evade monitoring or rate limits, or attempt to gain access to accounts, data, systems, networks, or areas of the Service that you are not authorized to access.
9. Ownership and Intellectual Property
The Service, including its design, code, text, graphics, logos, workflows, data structures, generated page layouts, and non-user content, is owned by BikingConditions.com or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership of the Service or any intellectual property rights to you.
10. Third-Party Services and Links
The Service may rely on, link to, display, or integrate third-party services, data, APIs, payment processors, AI providers, weather providers, hosting providers, email providers, CDNs, maps, or external websites. BikingConditions.com does not control and is not responsible for third-party services, data, content, policies, errors, outages, acts, omissions, or security practices.
11. Privacy
Please review the Privacy Policy for a summary of how information may be collected, used, stored, or shared in connection with the Service. The Privacy Policy may be updated at any time.
12. No Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, title, non-infringement, security, quiet enjoyment, or that the Service will meet your needs or expectations.
13. Limitation of Liability
To the maximum extent permitted by law, BikingConditions.com and its owner, operator, affiliates, service providers, licensors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; lost profits; lost data; lost credits; lost goodwill; service interruption; inaccurate results; personal injury; property damage; ride-related harm; or damages arising from your use of, inability to use, or reliance on the Service.
To the maximum extent permitted by law, the total liability of BikingConditions.com and its owner, operator, affiliates, service providers, licensors, and representatives for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid to BikingConditions.com for the Service in the three months before the event giving rise to the claim or ten U.S. dollars ($10).
14. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BikingConditions.com and its owner, operator, affiliates, service providers, licensors, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your User Content, your violation of these Terms, your violation of law, your ride or travel decisions, or your violation of another person's rights.
15. Termination
You may stop using the Service at any time. BikingConditions.com may suspend, restrict, or terminate your access to the Service at any time, with or without notice, for any reason or no reason, including suspected misuse, security risk, nonpayment, legal risk, excessive load, violation of these Terms, or conduct considered harmful to the Service or others. Termination may result in loss of access to accounts, credits, records, saved items, and User Content.
BikingConditions.com is not required to provide an explanation, warning, appeal process, refund, credit restoration, or opportunity to cure before or after any suspension, restriction, deletion, or termination, except where required by law.
16. Governing Law and Disputes
These Terms and any dispute arising out of or relating to the Service are governed by the laws of the State of Michigan, without regard to conflict-of-law rules, except where federal law or another law requires otherwise.
To the maximum extent permitted by law, you and BikingConditions.com agree that disputes will be resolved by binding individual arbitration rather than in court. You and BikingConditions.com waive any right to a jury trial and any right to bring or participate in a class action, collective action, private attorney general action, or representative proceeding. Claims must be brought only on an individual basis. This section does not prevent either party from seeking relief in small claims court where available or seeking temporary injunctive relief for misuse, security issues, or intellectual property violations.
17. Changes to These Terms
BikingConditions.com may update these Terms at any time. Updated Terms may be posted on this page, and your continued use of the Service after changes are posted means you accept the updated Terms. If you do not agree to the updated Terms, stop using the Service.
